What This Warranty Covers

This commercial warranty is provided by Kapitan Ivan Ltd. (the “guarantor”) in addition to the consumer’s statutory rights. It applies only to the guarantor’s products for which a 20-year warranty was expressly stated at the time of sale, and only to the AISI 304 stainless steel components incorporated in those products.

The warranty covers defects in the AISI 304 material, including loss of corrosion resistance under normal intended use, correct installation and compliance with the supplied maintenance instructions. It is not a 20-year warranty for other materials, mechanisms, the adhesive system or the functionality of the complete accessory, except where repair or replacement of the complete accessory is necessary to satisfy a covered claim.

Term, Eligible Products and Territory

The warranty period is 20 years and begins on the date the product is delivered to the first consumer. Time required for a warranty repair is added to the remaining period. Replacement preserves the original warranty conditions and the remaining period.

The warranty follows the product and may be used by a subsequent owner if the product and its delivery date can be reliably established.

Territorial scope: the Republic of Bulgaria. Where a product is sold to a consumer in another country, mandatory rights under the law applicable to that sale remain unaffected.

Only products for which the 20-year warranty is expressly stated on the packaging, product page, invoice, order confirmation or accompanying document are eligible. Coverage is limited to components identified as AISI 304 in the product specification.

Remedy Under the Warranty

For a valid claim, the guarantor will repair or replace the affected AISI 304 component. If that is not reasonably possible or does not restore normal use of the product, the guarantor will repair or replace the complete accessory with an identical or functionally and qualitatively equivalent product.

Repair or replacement will be provided free of charge, including necessary materials, labour, transport and, where applicable, removal and reinstallation of a correctly installed product. Performance will be without significant inconvenience to the consumer and within a reasonable time, but no later than one month after notice to the guarantor and availability of the product for inspection, unless objective circumstances require a different period permitted by law.

The guarantor may provide repair instead of replacement, or replacement instead of repair, where the consumer’s selected remedy is impossible or would impose disproportionate costs, without affecting the consumer’s mandatory rights against the seller.

How to Make a Claim

Send the claim by email to kapitanivanltd@gmail.com or in writing to the guarantor’s address stated at the end of this document. Include your name and contact details, the product and model (if known), the approximate purchase date and place, a description of the defect and your preferred remedy. Attach photographs where they can show the defect.

Provide a receipt, invoice, order confirmation, payment record or other reliable evidence of the product and delivery date. Absence of a particular form of document will not by itself result in refusal if the purchase and start of the warranty period can be established by other reliable means.

The guarantor will acknowledge receipt and provide instructions for inspection or shipment. Do not ship the product before receiving instructions. Where shipment is necessary, the guarantor will arrange it or reimburse reasonable shipping costs.

After inspection, the consumer will receive a written decision. A refusal must state the specific reason and the facts established. Making a claim under this warranty does not prevent a claim against the seller, a complaint to a competent authority or court proceedings.

Materials and Manufacturing

Accessories may contain AISI 304 stainless steel, plastics, powder coating, 3M™ VHB™ 4950 adhesive tape and other product-specific components. This 20-year warranty applies only to components identified as AISI 304.

AISI 304 stainless steel is commonly described as 18/10 stainless steel. Its specific chemical composition is governed by the applicable product specification and supplier documentation.

Intended Use and Maintenance

Products are intended for installation in bathrooms and other sanitary facilities and must be installed, used and maintained in accordance with the instructions for the particular product.

Clean the steel with a soft cloth, water and a mild neutral detergent, then rinse and dry. Do not use chloride-containing products or strong acids, abrasive cleaners, iron brushes, steel wool or other materials that may scratch or damage the surface. Iron particles deposited on the surface may oxidise and cause external rust staining.

Exclusions

The warranty does not cover a defect only to the extent that the guarantor establishes that it was directly caused by:

  • dropping, impact, scratching, abnormal force, misuse or use outside the intended purpose;
  • incorrect installation or proven failure to follow the supplied maintenance instructions;
  • contact with aggressive chemicals, chlorides, strong acids, abrasives or iron particles;
  • alteration, repair or intervention by an unauthorised person where that intervention caused the defect;
  • circumstances unrelated to the properties of the AISI 304 component, including failure of a pump, mechanism, plastic component, powder coating or adhesive system.

Normal ageing of components outside the coverage is not covered. An exclusion does not apply where the stated circumstance has no causal connection with the claimed defect. These limitations do not affect the seller’s statutory liability for lack of conformity of the complete product.

3M™ VHB™ 4950 Adhesive Tape

The tape and its adhesion are not covered by the 20-year AISI 304 material warranty. This does not exclude the seller’s statutory liability where the complete product or the mounting system supplied with it does not conform to the sales contract.

The tape performs best on smooth ceramic tile and glass. Do not install on uneven surfaces, painted walls, laminated doors or other low-adhesion substrates. The surface must be dry and thoroughly cleaned. Follow all instructions and warnings supplied by the manufacturer of any tape or primer used. Wait 48–72 hours after installing the base before loading the product.

Consumer Statutory Rights

If goods do not conform to the sales contract, the consumer is entitled by law to remedies against the seller free of charge. Those remedies are not limited or affected by this commercial warranty. Under Bulgarian law, the seller’s statutory liability for lack of conformity may generally be exercised for up to two years from delivery, subject to the conditions laid down by law.

Pickup from our factory in Lozen, Sofia is free.

Orders placed by 12:30 on a business day can be collected the same day until 16:30.
